Terms of Service

These Terms govern your purchase and use of the software tools sold under the name Poetato ("we", "us", "our"). By buying or using our software you agree to these Terms. If you do not agree, do not buy or use the software.

1.What we sell

We make digital PC software for the game Path of Exile, sold as licence keys and priced in pounds sterling (GBP):

  • Smoothtato- a visual and performance tool that patches game files on your own computer.
  • Botato- a game automation tool.

Each product is delivered instantly as a licence key, shown to you on-screen at the end of checkout and also sent to your email. The software runs locally on your own PC.

2.Your licence

A purchase grants you a personal, non-exclusive licence to use the software, tied to the key you receive. You do not buy the software itself or any intellectual property in it- only the right to use it under these Terms.

Keys are bearer credentials: whoever holds a key can use it, so you can save a key or give it to someone else. Treat a key like cash- if you lose it or share it publicly, we cannot get it back for you, and we have no way to re-send a key we did not record against an email.

How each key works

  • Smoothtato keys are limited to one active device at a time. You can move a key to a different device roughly once every 30 days.
  • Botato keys are metered by playtime- the key is consumed as you use it, up to the time balance you bought.

3.Acceptable use

The licence lets you use the software for yourself. You must not:

  • resell, redistribute, sublicense or otherwise make the software itself available to others (giving away a key you bought is fine- reselling copies of the software is not);
  • reverse-engineer, decompile, disassemble, crack, or otherwise attempt to derive the source code of the software, except to the limited extent this cannot lawfully be restricted;
  • circumvent, tamper with, or remove the licensing, metering, or device-binding mechanisms;
  • share a single key across multiple people or devices to evade metering or the one-device limit.

We may suspend or revoke a key that is being used in breach of these Terms.

4.Risk of using tools with Path of Exile

Please read this carefully before you buy.

Path of Exile is made and run by Grinding Gear Games (GGG). Using third-party tools with Path of Exile may breach GGG's own Terms of Service and could result in penalties on, or a permanent ban of, your game account.

You use our tools entirely at your own risk. Poetato is not responsible for any action taken against your game account- including warnings, suspensions, or bans- and this risk is a normal, expected part of using tools of this kind. We are not affiliated with, endorsed by, or connected to Grinding Gear Games in any way.

Our software runs on your own PC and does not touch your account credentials or GGG's servers, but that does not remove the risk described above. If account safety matters more to you than the benefit of the tool, do not buy it.

5."As is"- no warranty

The software is provided "as is" and "as available", without any warranty of any kind, so far as the law allows. In particular we do not warrant that the software is fit for any particular purpose, will be uninterrupted or error-free, or will keep working after a game update. Path of Exile changes often, and an update can break the software until we release a fix, or permanently.

6.Our liability

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so- including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

Subject to that, and so far as the law allows, our total liability to you for any claim relating to the software is limited to the amount you actually paid us for the licence giving rise to the claim. We are not liable for loss of your game account, loss of in-game items or progress, or for any indirect or consequential loss.

If you are a consumer, you have legal rights that these Terms do not affect. This clause does not take away any of those rights.

7.Payments and refunds

Payments are handled by Square, our payment processor. We never see or store your card number. Prices are shown in GBP and payable at checkout.

Because the software is digital content delivered instantly, special rules apply to cancellation and refunds. Please see our Refund Policy.

8.Privacy

We handle a limited amount of personal data to deliver and support your licence. How we do that, and your rights, are set out in our Privacy Policy.

9.Changes to these Terms

We may update these Terms from time to time- for example, to reflect changes to the products or the law. The version in force when you buy applies to that purchase. The "last updated" date at the top shows when this page last changed.

10.Governing law

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or your use of our services is subject to the exclusive jurisdiction of the courts of England and Wales.
